The Swaypay Rewards program (“Swaypay Rewards”) is offered by Swaypay It, Inc. (“Swaypay”, “we”, “us” or “our”). Participation in Swaypay Rewards is subject to these Swaypay Rewards Terms and Conditions (“Swaypay Rewards Terms”), the Swaypay Terms of Service, the Swaypay Privacy Policy, the Swaypay TikTok Post Policies, and any other agreement you may enter into with Swaypay from time to time (the “Swaypay Terms of Service”), which are incorporated herein by reference. Any new features or tools that are added to the current rewards offering will also be subject to the Swaypay Rewards Terms.
In order to participate as a Rewards Member in Swaypay you must reside in the United States and be either 18 years of age or older, or the Parent or Guardian agreeing on behalf of your child who is 14-17 years old, with a valid Swaypay account in good standing (“Swaypay Account”). You may only have one Swaypay Account and may not share memberships or have multiple memberships. However, there may be more than one Swaypay Account in a household. Memberships cannot be merged or transferred. During the initial phases of Swaypay Rewards, Swaypay may make Swaypay Rewards available on a rolling or staggered basis such that not all individuals will become eligible for Swaypay Rewards at the same time or receive the same benefits. By participating in Swaypay Rewards you agree to the Swaypay Rewards Terms. If you do not agree to the Swaypay Rewards Terms, do not participate in Swaypay Rewards.
Certain distribution options are provided by licensed money transmitters authorized by Swaypay to operate in connection with the Services (e.g., PayPal, Inc.) (“Authorized Money Transmitters”) and are subject to additional terms and conditions associated with your account with such Authorized Money Transmitter (the “Payment Provider Terms”). When you elect to collect Offers through an Authorized Money Transmitter, you further agree (i) that Swaypay is acting as your agent with respect to the payment processing, and (ii) that you are bound by the applicable Payment Provider Terms made available by that Authorized Money Transmitter, as such Payment Provider Terms may be modified by the Authorized Money Transmitter from time to time.
You can view your current Swaypay Rewards balance by navigating to your Wallet tab in the Swaypay App. If you think your Swaypay Rewards balance is incorrect, you must report your issue using the help center section in the Swaypay App. You should retain all receipts and documentation as may be necessary to verify your issue. For verification, you may be asked to provide certain information. All personal information collected from you in connection with your use of Swaypay is governed by the Swaypay Privacy Policy. Failure to supply necessary information or documentation may result in an inability to reward Swaypay Rewards.
Participation in the Swaypay Rewards is a privilege granted to Rewards Members, and as such can be suspended, revoked or terminated by Swaypay at any time and for any reason. If your Swaypay Rewards membership is terminated, all Swaypay Rewards associated with your Swaypay Rewards membership or any other benefits will be forfeited immediately upon termination. If your Swaypay Rewards membership is terminated due to fraudulent activity or noncompliance with the Swaypay Rewards Terms, in addition to forfeiting all Swaypay Rewards and any other benefits associated with your Swaypay Rewards membership immediately, you cannot participate in or rejoin Swaypay Rewards or the Swaypay Services. If your Swaypay Account is closed or terminated, you will lose all Swaypay Rewards. This section does not limit any other rights or remedies Swaypay may have under the Swaypay Terms of Service or other agreements with you.
Swaypay Rewards or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons. Swaypay is not responsible or liable for any lost, stolen, late, incomplete, illegible, interrupted, delayed, or misdirected push notifications, e-mail, Offers, or Offer-related materials or correspondence. We are not responsible for any unavailability, interruptions or errors of Swaypay Rewards or its features. Swaypay is not responsible for unauthorized use of Swaypay Rewards. If your Swaypay Account is closed or terminated, you will lose all Swaypay Rewards. Swaypay may from time to time request information from you to confirm your identity before it will allow use of your Swaypay Rewards. Swaypay may delay your access to the Swaypay Rewards until you comply with this information request. The Swaypay Rewards program and all the information accessible through it are provided for information purposes only on an "as is" and "as available" basis. We, our information providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Swaypay Rewards program, the information, materials, content, availability, and products. All benefits and rewards made available under the Swaypay Rewards program, if any, are provided by Swaypay and do not modify the contractual relationships among or between Rewards Members, the individuals and entities that use Swaypay’s technology to offer goods or services, and Swaypay or any Swaypay affiliates, except as expressly set forth herein. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Capitalized terms used but not defined herein will have the meaning as set forth in the Swaypay Terms of Service.
“Swaypay Services” means the Swaypay App mobile application and other products and services that, among other things, allow you to earn cash back on your purchases, organize your orders and check delivery status, and browse and Swaypay from Swaypay Merchants.
“Swaypay Merchant(s)” means the Swaypay merchants who sell goods or services to Swaypay Users and offer rewards through the Swaypay App.
“Swaypay App” means the Swaypay mobile application, either iOS or Android, that allows you to track orders and shipments, and browse and Swaypay from Swaypay Merchants.
“Swaypay Rewards” means the Swaypay cash rewards program including Offers or benefits that are otherwise earned by using the Swaypay Services, and which can only be redeemed for cash back or other benefits in the Swaypay App.
“Swaypay User” means a user of the Swaypay Services.
“Rewards Member” means a Swaypay User who accepts Offers or otherwise earns Swaypay Rewards and participates in the Swaypay Rewards program.
"Authorized Money Transmitters" refer to the Third Party services such as PayPal that you use to cash out your Swaypay balance.
“Payment Provider Terms” mean the Terms you agree to when using Third Party services such as PayPal to cash out your Swaypay balance.
